Copyright or Intellectual Property Infringement Notice

VidaCeuticals Health Products Inc. (VidaCeuticals) has adopted the following policy regarding copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). VidaCeuticals respects the intellectual property rights of others. If you want to claim a possible copyright infringement, you can notify us. We will review all claims of copyright infringement and remove any content that violates DMCA.

To make a claim, please provide the following:

  1. A signature (electronic or physical) of the authorized person to act on behalf of the owner of the intellectual property that is allegedly infringed.
  2. The description of the copyrighted work that you claim has been infringed.
  3. A description of where the copyrighted material is located on VidaCeuticals.com
  4. How to contact you: Name, address, telephone number and email.
  5. Include a statement that you, in good faith, believe that the use of the intellectual property you are claiming is not authorized by the copyright owner or the law.
  6. Include a statement that the above information in your claim is accurate and that you, made under penalty of perjury, are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

Provide the above list to the designated agent to receive and act on copyright violations under the Digital Millennium Copyright Act (“DMCA”)(the “Designated Agent”). The contact information for the Designated Agent is listed below.

PLEASE NOTE THAT IF YOU KNOWINGLY MISREPRESENT THAT ONLINE CONTENT IS INFRINGING, YOU MAY BE SUBJECT TO CIVIL PENALTIES. THESE PENALTIES MAY INCLUDE MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS FEES INCURRED BY US, BY ANY COPYRIGHT OWNER, OR BY ANY COPYRIGHT OWNER’S LICENSEE THAT IS INJURED AS A RESULT OF OUR RELYING UPON YOUR MISREPRESENTATION. YOU MAY ALSO BE SUBJECT TO CRIMINAL PROSECUTION FOR PERJURY.

Counter-Notice

If the user believes that the content that was removed or to which access was disabled is not infringing or believes that it has the right to post and use such content from the copyright owner, the user must send a counter-notice to the Designated Agent containing the following information:

  1. A signature (electronic or physical) of the user
  2. The description of the content that was removed and where it was located on VidaCeuticals.com before it was removed.
  3. A statement that the content was removed as a result of a mistake in good faith. Or was removed as the result of a misidentification of the content.
  4. The users contact information: Name, address, telephone number, and, if available, e-mail address and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the user’s address is located, or if the user’s address is located outside Canada, for any judicial district in which VidaCeuticals Health Products Inc. is located, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement.

If VidaCeuticals Health Products Inc. receives a counter notice, it may send a copy to the original complainant to inform them that the disputed material may be restored in 10 business days or more. This restoration will take place unless the copyright owner takes legal action to obtain a court order against the user. VidaCeuticals Health Products Inc. reserves the right to decide whether to restore the material or not, and this decision may be made ten business days or more after receiving the counter-notice.
